Participation Agreement - September 2026
Parties. In this agreement, "Vivo" means Vivo Hospitality and Property Management LLC (Florida) for properties located in the United States, and Vivo Hospitality and Property Management SRL (RNC 1-32-86679-7) for properties located in the Dominican Republic. "You" means the person or business named in the submission form who registers the referral.
1. What a referral is. A referral is a property owner you introduce to Vivo who was not already in conversation with us. You register the owner using the referral form; the submission timestamp establishes the introduction. Vivo will confirm or decline the registration within three (3) business days of submission. Where two participants register the same owner, the earlier timestamp prevails.
2. Your relationship stays yours. We never contact your client without your permission, and you are copied on every communication with them.
3. Who can participate. The program is open to any person or business, except those holding a decision-making or position-of-trust role in relation to the referred property or its owner. This includes, without limitation, condominium board members, building administrators, and anyone involved in selecting or overseeing management providers for that property. If your relationship with the owner could give rise to a conflict of interest, tell us at registration. Vivo will assess the situation and may accept the referral without a fee, or decline it.
4. Compensation. If an owner you refer signs a management agreement with Vivo, you receive a one-time referral fee of US$500 per property. The fee is paid by the Vivo entity that signs the management agreement. It is paid within thirty (30) days of the end of the month in which the property completes its first paid guest stay, and is subject to applicable tax withholding and to your provision of any required tax documentation. No further fee is payable in respect of that property. This fee is paid for an introduction only. It is not a commission on a sale or lease and is not contingent on any real estate transaction. If you hold a real estate license, you are responsible for complying with your brokerage's policies on outside compensation, including any requirement that the fee be routed through your brokerage. Tell us at registration if payment should be directed to your brokerage rather than to you.
5. Registration period. A referral is registered to you for six (6) months from the date of submission. If the registration expires without a signed management agreement, no fee is payable and the registration simply lapses. Where an owner is bound by an existing exclusive management contract at the time of referral, Vivo may extend the registration period in writing.
6. Acceptance is at Vivo's discretion. Vivo may decline any referral, including where the property does not meet our intake criteria or falls outside our service areas. Registration of a referral does not oblige Vivo to make a proposal or to accept the property under management.
7. Owner consent and confidentiality. By registering a referral you confirm that the owner has agreed to their details being shared with Vivo for this purpose. Owner details are used solely to prepare a proposal and to manage the property if appointed. They are never sold or shared with third parties.
8. Independent parties. Nothing here creates an employment, agency, or partnership relationship between you and Vivo. Either party may end this agreement in writing at any time. Referrals already registered at the time of termination continue to be honored under clause 4.
9. Acceptance of these terms. By submitting the referral form you accept this agreement in the version in force on the date of submission. Vivo may amend the program at any time; referrals already registered are governed by the version in force when they were registered.
10. Governing law and language. Referrals of properties in the Dominican Republic are governed by the laws of the Dominican Republic. Referrals of properties in the United States are governed by the laws of the State of Florida. This agreement is issued in Spanish and in English. In the event of any discrepancy, the Spanish version prevails.

Partes. En este acuerdo, "Vivo" significa Vivo Hospitality and Property Management LLC (Florida) para inmuebles ubicados en los Estados Unidos, y Vivo Hospitality and Property Management SRL (RNC 1-32-86679-7) para inmuebles ubicados en la República Dominicana. "Usted" significa la persona o empresa identificada en el formulario de referimiento que registra el referido.
1. Qué constituye un referido. Un referido es un propietario que usted presenta a Vivo y que no se encontraba ya en conversación con nosotros. Usted registra al propietario mediante el formulario de referimiento; la fecha y hora del envío establece la presentación. Vivo confirmará o rechazará el registro dentro de los tres (3) días hábiles siguientes al envío. Cuando dos participantes registren al mismo propietario, prevalece el envío con la fecha y hora más temprana.
2. Su relación sigue siendo suya. Nunca contactamos a su cliente sin su autorización, y usted recibe copia de toda comunicación con él.
3. Quiénes pueden participar. El programa está abierto a cualquier persona o empresa, salvo quienes ocupen una posición de decisión o de confianza respecto del inmueble referido o de su propietario. Esto incluye, sin limitarse a, miembros de juntas de condominio, administradores de edificios, y cualquier persona que participe en la selección o supervisión de proveedores de administración para ese inmueble. Si su relación con el propietario podría dar lugar a un conflicto de intereses, indíquelo al momento del registro. Vivo evaluará el caso y podrá aceptar el referido sin honorario, o rechazarlo.
4. Compensación. Si un propietario que usted refiere firma un contrato de administración con Vivo, usted recibe un honorario único por referido de US$500 por inmueble. El honorario lo paga la entidad de Vivo que suscriba el contrato de administración. Se paga dentro de los treinta (30) días siguientes al cierre del mes en que el inmueble complete su primera estadía de huésped pagada, y está sujeto a las retenciones fiscales aplicables y a que usted entregue la documentación fiscal requerida. No se genera ningún honorario adicional respecto de ese inmueble. Este honorario se paga únicamente por la presentación. No constituye una comisión sobre una venta o un alquiler, ni está condicionado a ninguna transacción inmobiliaria. Si usted posee una licencia inmobiliaria, es su responsabilidad cumplir con las políticas de su agencia en materia de compensación externa, incluyendo cualquier requisito de que el honorario se canalice a través de la agencia. Indíquenos al momento del registro si el pago debe dirigirse a su agencia en lugar de a usted.
5. Período de registro. Un referido queda registrado a su nombre por seis (6) meses a partir de la fecha de envío. Si el registro vence sin que se haya firmado un contrato de administración, no se genera honorario alguno y el registro simplemente caduca. Cuando un propietario esté vinculado por un contrato de administración en exclusiva vigente al momento del referimiento, Vivo podrá extender el período de registro por escrito.
6. La aceptación queda a discreción de Vivo. Vivo podrá rechazar cualquier referido, incluyendo casos en que el inmueble no cumpla con nuestros criterios de admisión o se encuentre fuera de nuestras zonas de servicio. El registro de un referido no obliga a Vivo a presentar una propuesta ni a aceptar el inmueble bajo administración.
7. Consentimiento del propietario y confidencialidad. Al registrar un referido, usted confirma que el propietario ha consentido en que sus datos sean compartidos con Vivo para este fin. Los datos del propietario se utilizan únicamente para preparar una propuesta y para administrar el inmueble en caso de ser designados. Nunca se venden ni se comparten con terceros.
8. Partes independientes. Nada de lo aquí establecido crea una relación laboral, de agencia ni de sociedad entre usted y Vivo. Cualquiera de las partes puede dar por terminado el acuerdo por escrito en cualquier momento. Los referidos ya registrados al momento de la terminación continúan siendo honrados conforme a la cláusula 4.
9. Aceptación de estos términos. Al enviar el formulario de referimiento usted acepta este acuerdo en la versión vigente a la fecha del envío. Vivo podrá modificar el programa en cualquier momento; los referidos ya registrados se rigen por la versión vigente al momento de su registro.
10. Legislación aplicable e idioma. Los referidos de inmuebles ubicados en la República Dominicana se rigen por las leyes de la República Dominicana. Los referidos de inmuebles ubicados en los Estados Unidos se rigen por las leyes del Estado de Florida. Este acuerdo se emite en español y en inglés. En caso de discrepancia, prevalece la versión en español.
